The Service

Traitorbird (traitorbird.com and related domains and services) is a website and service operated by Whaup Limited. The service provides tools that can be used to help detect intrusion into systems, including generating Canary Token Credentials to third party services (Canaries). We reserve the right to change or discontinue any or all of the service temporarily or permanently, and introduce new features or products at any time. We take reasonable measures to ensure the service is reliably available, but we will not be liable if our service is unavailable or fails to function.

Due to the way the service works we cannot provide a guarantee that the service will detect every intruder on a system where you place a Canary generated by the service. The detection ultimately depends on tricking the intruder into attempting to use the Canary, and they may not always notice the Canary, may deliberately avoid using it, or otherwise evade detection.

Third Party Services

Our provision of the service relies on certain third party services, such as web hosting, network connectivity, Amazon Web Services and other cloud providers. The interruption or failure of these third party services may cause an interruption or failure to the service that is beyond our control.

Your Use of the Service

You must be at least 18 years old to use the service. Due to the nature of the service there may be ways in which it is technically possible to use it that are not permitted by law. You are responsible for complying with the law when using the service.

You have a limited, non-exclusive, non-transferable and revocable license to use the service only as long as you comply with these Terms of Use. You must not create derivative works, make modifications to the service, interfere with its functioning, or circumvent any restriction on the service. When using the service you must comply with all local laws in your own jurisdiction, the law in Ireland where our service is hosted, and the law in Scotland where we are based.

You must not use the service to harass or promote harm to anyone, to infringe upon the rights of anyone, to send any unsolicited communication, or in any other way that we at our sole discretion deem to be objectionable.

Your Account

You are required to create an account to access the service. You must only create an account for yourself and you must not share your account with others. You must provide accurate information when creating your account. Sign in to your account is by email confirmation, and you must not share email confirmation links or codes with anyone else in order to keep your account secure.

Payment Terms

If you sign up for a paid subscription you must provide a valid payment method, and complete any payments that you agree to make. Your paid subscription will continue every year until you cancel it. You may cancel a paid subscription at any time, and you will not be charged for any further billing periods after you cancel, but you will still be liable for any outstanding payments for past periods which were unpaid, unless we agree otherwise.

Price

We will not unreasonably vary the price of existing subscriptions, but the price may change due to changes in taxes or increases in our costs. We will let you know if the price of your existing subscription will increase. We may change the price for new subscriptions for any reason at any time, and we may offer different prices in different geographical regions.

Feedback

We appreciate your questions and feedback. By providing any feedback to us you authorise us to use your feedback for any purpose, including the development of new features or products. We will not be obliged to provide any attribution or compensation for use of your feedback.

Your Content

Certain aspects of the service may include storing and transmitting content that you have uploaded to the service (such as your names or descriptions for resources). By uploading such content to the service you warrant that you have permission from the rights holder to do so, and you grant us all the necessary licenses and permissions necessary to use your content to provide the service.

We may review your content that you upload to the service, in order to monitor and improve the functionality of the service, and to monitor and enforce your compliance with these terms.

Intellectual Property

The site itself and the information on it are protected by copyright laws and treaties worldwide. We own and reserve all intellectual property rights to the site and service, except where stated.

Termination

We may suspend or terminate your access to the service at our own discretion.

Indemnity and Limitation of Liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law we expressly exclude all liabilities relating to your use of the site or service. The materials contained on our site do not claim to be or constitute legal or other professional advice and shall not be relied upon as such.

Communications

By using the service you agree to receive communications necessary for the functioning of the service, such as log-in confirmation emails and notification emails. We will only send you additional marketing emails if you opt in.

We may revise these terms of use at any time by amending this page.

Governing Law

The laws of Scotland govern your use of this service, and the courts of Scotland will have non-exclusive jurisdiction over any claim arising from, or related to, a visit to our site or use of our service.

Your Data and Privacy Policy

Data we Collect

You will provide us personal information during the course of using the service. This includes your email address for sign-in, and information you provide when making a payment or contacting customer support.

We may also collect personal information about you during your interactions with the service, and your interactions with Canaries generated by the service. This includes your IP address and browser and device information.

We use cookies to keep your account secure, and may also use cookies to measure and improve usage of the service.

How we use your Data

We use your data to provide the service to you. Our lawful basis for processing your data is a legitimate interest to provide you the service.

We may also use your data to provide you with customer support.

If you opt in, then we may use your data to send you marketing communications.

We also use your data to allow you to make payments and to prevent fraud or misuse.

Data Shared with Others

We share your data with others as required to provide the service to you. For example, when you add someone as a recipient for notification emails we will provide them your email address so that they know who is requesting permission to send them notifications. If you interact with a Canary generated by the service then your IP address, device and other information about your interaction will be shared with the notification recipients for the Canary.

Some data is shared with Paddle, the merchant of record who sell our service to you, so that you can create subscriptions and manage your payments. This data includes your email address, which is used to identify your account. Paddle will also collect their own data about you to enable payments and prevent fraud, you can read their policy at paddle.com/legal/privacy.

Storing your Data

Your Data is stored in AWS datacenters in Ireland.

We will store your data for as long as necessary for us to fulfill the purposes described above, and may store it for an additional period of time in order to ensure the reliable operation of the service, such as for backups or disaster recovery.

If we become aware of a breach of the your personal information that we store, then we will let you know.

To request deletion of your account and data please contact us, sending your message from the email address that you use to sign in.
